New Regulations on the Introduction of Energy Certification for Buildings in Portugal

With the objective to reduce energy costs, improve insulation and preserve the environment, the Energy Certification for all buildings has been introduced to take into account the quantity and energy efficiency aspects in connection with location, sun exposure, construction materials and equipment. The type and level of requirements relate to the function/type of building concerned (ie, dwellings, office buildings, schools, etc.). Control of this regulation is the responsibility of the City (Town Hall), where the building is located, based upon a Declaration of Compliance from the Building Regulations Authority which can only be issued by an accredited expert registered in the SCE (Building Certification System). The Energy Efficiency of Properties Certificate is graded from A+ (excellent) to G (lowest efficiency grade). As a consequence, the grade which your property receives, in the future may have a beneficial impact on your annual property tax (IMI). All buildings will require certification from January 1st 2009. As of 1st. of January all new properties and all properties sold by Notarial deed need to have/produce this certificate. Also properties subject to a normal rental contract (for 5 years) need to have one (when registering the rental agreement with the finance dept this certification will be requested). The owners who do not comply with the new regulations could incur penalties (residential buildings from € 250 to € 3741; commercial buildings from € 2500 to € 44 892).
